1. Acceptance of Terms
By accessing or using Koali ("the Software"), you agree to be bound by these terms. If you do not agree, do not use the Software.
2. Licence
Koali is provided free of charge. You are granted a non-exclusive, worldwide, royalty-free licence to use, copy, and distribute the Software for any purpose, including commercial use, subject to the conditions below.
3. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The author makes no warranty that:
- The Software will meet your requirements or expectations.
- The Software will be uninterrupted, timely, secure, or error-free.
- The results obtained from use of the Software will be accurate or reliable.
- Any defects in the Software will be corrected.
4. Limitation of Liability
IN NO EVENT SHALL THE AUTHOR OR COPYRIGHT HOLDER BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
This includes, without limitation, any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of data, research work, profits, goodwill, or other intangible losses, even if the author has been advised of the possibility of such damages.
5. Your Data
Koali operates entirely on your local machine. The author has no access to, control over, or responsibility for any data you create, import, analyse, or store using the Software. You are solely responsible for backing up your data and ensuring its integrity.
6. No Obligation
The author is under no obligation to provide support, maintenance, updates, enhancements, or modifications to the Software. Any such provision is entirely at the author's discretion.
7. Use at Your Own Risk
You use the Software entirely at your own risk. You are responsible for determining the appropriateness of using the Software and assume all risks associated with its use, including but not limited to the risks of data loss, system damage, or research inaccuracies.
8. Changes to These Terms
The author reserves the right to modify these terms at any time. Continued use of the Software after changes are posted constitutes acceptance of the revised terms.
9. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
